Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the Apna Poster mobile application, website, and related services (the "Service"), operated by Insure Marketing Solutions Pvt Ltd ("we", "our", "us"). By using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, downloading the app, or using any part of the Service, you confirm that you are at least 18 years old and agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Description of Service

Apna Poster provides ready-to-use and customisable posters, videos, reels, greetings, digital business cards, logos, frames, and related marketing content for businesses, political profiles, and insurance/LIC professionals. Some features are free; others require a paid subscription.

3. Accounts & Registration

• You must provide accurate and complete information when registering.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• Notify us immediately of any unauthorised use of your account.

4. Subscriptions & Payments

• Paid plans (e.g. Starter, Pro, Business+) are billed in advance on a weekly, monthly, or yearly basis as selected.
• Promotional pricing (such as introductory offers) applies only for the stated period and to eligible users.
• Prices are inclusive or exclusive of applicable taxes as indicated at checkout.
• Subscriptions may auto-renew unless cancelled before the renewal date, where applicable.
• Refunds and cancellations are governed by our Refund & Cancellation Policy.

5. Acceptable Use

You agree NOT to use the Service to:

• Create or distribute content that is unlawful, defamatory, obscene, hateful, or that incites violence.
• Infringe the intellectual property, privacy, or other rights of any person or entity.
• Impersonate others or misrepresent your affiliation with any person or organisation.
• Spread misinformation, including misleading political or electoral content in violation of applicable laws.
• Upload viruses, malware, or attempt to disrupt, hack, or reverse-engineer the Service.
• Resell, sublicense, or commercially exploit the Service except as expressly permitted.

We reserve the right to remove content and suspend or terminate accounts that violate these Terms.

6. User Content & Responsibility

• You retain ownership of the photos, logos, and content you upload.
• You grant us a limited licence to use, store, and process your content solely to provide the Service.
• You are solely responsible for the content you create, publish, and share, and for ensuring you have the rights to any images, names, or logos you upload.
• You must comply with all applicable election, advertising, and insurance-marketing regulations when using political or insurance content.

7. Intellectual Property

The Service, including templates, design assets, software, logos, and the "Apna Poster" brand, is owned by or licensed to Insure Marketing Solutions Pvt Ltd and is protected by intellectual property laws. Templates and assets are provided for use within the Service; you may not extract, redistribute, or resell them outside the intended use.

8. Referral & Wallet Program

The Refer & Earn and Wallet features are offered at our discretion. We may modify, suspend, or discontinue these programs, and may adjust reward values or withdrawal conditions, at any time. Fraudulent activity may result in forfeiture of rewards and account suspension.

9. Third-Party Services

The Service may integrate third-party tools (payment gateways, social platforms, messaging). Your use of those services is subject to their respective terms. We are not liable for third-party services.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that content will achieve any specific marketing result.

11. Limitation of Liability

To the maximum extent permitted by law, Insure Marketing Solutions Pvt Ltd shall not be liable for any indirect, incidental, special, or consequential damages, or loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the preceding three months.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any unlawful conduct. You may stop using the Service and request account deletion at any time.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bhopal, Madhya Pradesh.

14. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted with a new "Last updated" date. Continued use of the Service constitutes acceptance of the revised Terms.
